A civil procedure is initiated by filing a lawsuit with a competent court. After the lawsuit is served to the defendant, the defendant has the opportunity to formulate a response, which is referred to as an answer to the complaint. Court hearings follow, eventually leading to a judicial decision.

A first-instance judgment can be appealed by the losing party. This appeal is reviewed by a higher instance. In Austria, there are three instances in civil procedures, with the Supreme Court being the final instance.

The costs consist of attorney fees, court fees, and possibly costs for experts. In Austria, it is customary for the losing party to bear the legal costs. Since the costs to be reimbursed are based on the Attorney Fees Act, they may differ from the costs agreed upon with one’s own lawyer.
