When can consent judgment be agreed upon?

A consent judgment can only be agreed upon by the parties during the oral proceedings and ends the legal dispute or clears it of individual points in dispute. If it is directed at a performance, it also represents an execution title. The court shall seek or attempt to reach a settlement in any procedural situation.

 

It is questionable whether a claim on which a settlement has been reached can be sued for again. According to case law, however, such a claim must be dismissed, which means that the claim cannot be asserted (again).
