How is the family name determined?

With regard to the choice of name, the spouses are predominantly free. Either the husband’s name or the wife’s name can be chosen as the family name. Double names consisting of both surnames are also possible. If the respective surnames before marriage again consist of several parts of the name, parts of this name can also be used. In total, however, the family name may only consist of two parts.

 

Example: If Mr. Huber-Mayer and Mrs. Berger-König marry, the following name combinations are possible:

 

  • Huber
  • Mayer
  • König
  • Berger
  • Huber-Mayer
  • Berger-König
  • Huber-Berger (or vice versa)
  • Huber-König (or vice versa)
  • Mayer-Berger (or vice versa)
  • Mayer-König (or vice versa)

 

If no name is determined, the spouses keep their previous family name. If divorce occurs, there is the possibility of continuing the family name or adopting the previous family name.
