The Public Liability Act (AHG) regulates claims for compensation for all damage caused by public bodies in the execution of laws. However, the AHG is only applicable in the area of sovereign administration (judiciary and executive), but not if the conduct is private.
Significant deviations from damages under the ABGB are:
- the damage must be compensated in money in any case – there is no restitution in kind
- the legal entity (e.g. the federal government) is always liable, never the body itself
- the absolute limitation period is only 10 years instead of 30 years
