FAQ

What does inheritance law regulate and what is its purpose?

Inheritance law regulates the (legal) end of a person’s life and thus the fate of his or her hereditary rights and obligations. It is therefore relevant insofar as everyone is affected by it – whether as heir or as decedent (deceased).

In inheritance law, the principle of family succession applies, according to which the estate should in principle go to the families. However, this principle is broken by the decedent’s ability to determine who is to receive the assets within the framework of testamentary freedom. The only restriction here is the right to a compulsory portion, which guarantees certain relatives a minimum share of the assets.
