What should I pay special attention to when concluding a waiver?

In particular, the presumption of extension to the compulsory portion and the presumption of extension to the descendants must be observed.

 

If nothing else is agreed, the waiver also extends to the compulsory portion. If only certain parts of the estate are to be waived, this should be considered and agreed accordingly. Furthermore, it should be considered that the waiver, if there is no corresponding agreement, also refers to the descendants of the heir subject to the waiver.
