If an adult person, due to a mental illness or a similar impairment of decision-making capacity, can no longer manage certain legally regulated matters without risking harm to themselves, they can be represented in these matters by one or more next of kin.
The matters covered by the representation include:
- Representation in legal proceedings
- Management of income, assets, and liabilities
- Conclusion of legal transactions to cover care and support needs
- Decision-making regarding medical treatments
- Change of residence
It should be noted that legal adult representation only comes into effect if the person has not independently appointed a representative for the respective matters and is unable or unwilling to choose a representative.
