When and how is an administrative procedure initiated?

An administrative procedure can generally be initiated in two ways:

  • Upon application of a party, if this possibility is provided for in the substantive law
  • Ex officio

There are no provisions on how the procedure is to be initiated – therefore, there is freedom of form. Once the administrative authority has taken an initial action, the procedure is initiated.
