How is the penalty determined?

The determination of the penalty within the penalty framework is at the discretion of the authority. Various criteria must be considered in this regard. On the one hand, the significance of the legal interest and the intensity of the impairment are relevant, and on the other hand, mitigating and aggravating factors must be balanced against each other. Economic capacity also plays a role.
