When can one be detained under the VStG?

To ensure the conduct of proper proceedings, the administrative authorities or their organs are authorized to take certain measures – including arrest, security deposits, or identity verification.

Thus, the public security service organs – mainly federal police officers – are authorized to arrest a suspect for the purpose of presenting them to the authority. However, this arrest is only permissible if the person is caught in the act and one of the following reasons for arrest applies:

  • lack of identifiability
  • risk of flight
  • risk of further offense or repetition
