FAQ

By whom must fault be proven?

The burden of proof – i.e. the burden of proving fault – generally lies with the injured party. Only in the event of a breach of a contractual or statutory obligation does the injuring party have to prove that he is not at fault – this is referred to as shifting the burden of proof.
