Can a procedure that has already been concluded with legal effect be repeated?

A reopening of the procedure is possible if there are special reasons that cast doubt on the correctness of the decision. However, reopening is only possible if the procedure has been concluded by decision and no legal remedy is available against this decision.

Important reasons include:

  • The decision was brought about or obtained by forgery of a document or other criminal acts punishable by a court
  • New facts or evidence have emerged that could not have been asserted without fault of the party and would likely have led to a different result
  • The decision depended on a preliminary question that was decided differently by the competent authority at a later date
  • Subsequent knowledge of a decision or a judicial decision that would have justified the objection to the matter already decided
