Can the number of parties change in the course of the proceedings?

It may be that during the proceedings, further parties are added to the original ones—this is then referred to as party accession. However, such an accession is only provided for by law in the form of the accession of an intervening party (see above).

 

If, on the other hand, a new party enters the proceedings in place of a withdrawing party through legal succession, this is referred to as a change of party. This change can either be provided for by law (e.g. heirs after inheritance upon death) or, if the law provides for this possibility, by consent of the parties (e.g. joinder of an intervening party).
