The division of assets shall be made in accordance with the principle of equity and shall be based on the weight and extent of the contribution made by each spouse to the acquisition of the personal property and the accumulation of the savings. The best interests of the child shall also be taken into account. In particular, the income from the acquisition as well as all other contributions during the marriage (e.g., child care, participation in the acquisition, keeping the household) shall be considered as contribution.
The division itself is carried out by allocating the property covered by the division to the spouses. If this division leads to an inequitable result for one party, the court may remedy this inequity by ordering a compensation payment.
