How do you know when an offense falls under the jurisdiction of a court or administrative authority?

The decision primarily lies with the legislator, who decides based on political discretion who is competent. Only for serious crimes and political offenses is the competence of the jury or lay judges’ courts constitutionally provided.

It is also important to note that there is a constitutional limitation on the competence of administrative authorities to impose imprisonment. Accordingly, the maximum limit is six weeks or three months if imposed by an independent authority.
