How does the first-instance procedure end?

The administrative procedure is generally concluded by the issuance of a decision. In some cases, however, the procedure can also be concluded without a decision – namely by termination of the proceedings or by carrying out the requested act (e.g., issuance of a certificate).

Termination occurs in cases of:

  • Withdrawal of the application by the applicant or in the event of the death of the applicant without the entry of a successor
  • Elimination of the reason for further administrative action, or if it becomes apparent that nobody has a right to the issuance of a decision
