The spousal maintenance to be paid during the marriage ends when the divorce decree becomes final. However, in certain serious cases, maintenance may still be due after the divorce.
The spouses are free to settle post-marital maintenance by mutual agreement. If there is no such arrangement, the maintenance claim depends primarily on the fault of the partner or on the type of divorce.
