Is an investigative procedure always required?

No, the investigative procedure can be waived in exceptional cases if a summons with a decree has been issued, in the mandate procedure, or if the facts are already clearly established.

A mandate decree can be issued, in particular, if urgent measures need to be taken due to imminent danger (e.g., withdrawal of a driver’s license in the absence of reliability in road traffic).
