Is disinheritance possible and if so, under what conditions?

Disinheritance is the withdrawal of the compulsory portion by testamentary disposition, in the presence of a ground for disinheritance.

 

Examples of such reasons include:

 

  • certain judicially punishable acts against the decedent
  • gross neglect of family law obligations towards the decedent
  • sentencing to life imprisonment or 20 years imprisonment for one or more criminal acts committed with intent
  • infliction of severe emotional distress on the decedent
