Legal costs and their compensation?

As in the contentious proceedings, the costs of the proceedings consist of the cash expenses and the representation costs for the lawyer.

 

The basic rule for the reimbursement of costs in non-contentious proceedings is that the court shall decide the extent to which the costs are to be reimbursed without further investigation and after careful consideration of all the circumstances. If parties with conflicting interests are opposed, the obligation to compensate shall apply to all costs necessary for the appropriate prosecution and defense. The decisive factor is the success of the proceedings. In the event of partial success, the costs may be set aside or compensated on a pro rata basis.

 

For reasons of equity, however, reimbursement of costs may also be awarded irrespective of the success, provided this appears to be necessary.
