What are the obligations arising from the marriage?

The spouses have the duty of comprehensive partnership. This includes in particular:

 

  • Duty to live together

This is about the fact that the spouses should live in one household. The place of residence is to be chosen by mutual agreement, whereby each spouse has the right to request a transfer for justified reasons (e.g., professional practice).

 

  • Duty of loyalty

The duty of loyalty covers not only the sexual sphere, but also anything that may seriously disturb the relationship of trust between the partners.

 

  • Duty to assist

The duty to provide assistance includes, in particular, psychological assistance in all situations and care in the event of illness. The duty to provide assistance also includes the duty to provide spousal support, support in the household, assistance in earning a living and the right to housing protection.

 

  • Duty of decency decency
