If party status was wrongfully denied, one is considered an “overlooked party.” As such, one does not lose party status but has various options to assert it:
- Filing an application for a decision on party status
- Filing a request for service of the decision and subsequently filing a complaint or appeal
- If the decision has not been served on the overlooked party but its content is known, it can file an appeal or complaint. Merely being aware of it without service does not trigger the deadline for appeals.
- Asserting a a claim for injunctive relief, if provided for
