What enforcement measures are available?

Within the framework of a substitute performance, services that can be provided by someone other than the obligated party can be carried out at the expense of the obligated party after notice and setting a deadline if the obligated party has not fulfilled its obligation.

For unfeasible actions – i.e., those that cannot be carried out by third parties due to their nature – coercive fines can be imposed. Either monetary or custodial penalties may be considered.

As a last resort, the decision-made state can be restored through direct coercion.
