FAQ

What happens if more than one person causes damage?

There are also constellations in which not only one person is the cause of the damage. If this is the case, all parties involved are jointly and severally liable for the total damage. Of course, the injured party can only demand the value of the damage once from one of the injuring parties involved – otherwise he would be in a better position in a comparison of his assets to the prior situation. In the relationship of the injuring parties among themselves, the one who was obligated to pay compensation can take recourse against the other. The share of the individual injuring party in the total compensation depends in principle on the severity of the fault.
