What is a measure complaint, and when can it be raised?

The aim of the measure complaint is for the administrative court to declare the contested act of direct administrative command and coercive power (DACC, in German “AuvBZ”) unlawful and annul it. A DACC exists when an administrative body unilaterally issues a command or exercises coercion against a specifically identified recipient in the course of sovereign administration. A typical example of such an act is detention.

Entitled to lodge a complaint is anyone who can credibly claim to have been infringed upon in their rights by the DACC. The deadline for filing is six weeks and generally begins with the time of knowledge or the cessation of hindrance. It must be submitted in writing to the competent administrative court.

The content of the complaint corresponds to that of the decision complaint.
