When can you claim damages?

In principle, the following conditions must be met in order for damages to be claimed:

 

  • Damage
  • Causation
  • Unlawfulness
  • Fault

 

If one of these elements is missing, there is no claim for compensation. It should be noted, however, as already mentioned above, that in the case of strict liability, the existence of unlawfulness and fault are not relevant.
