Which laws are particularly important in the context of administrative proceedings, and what is the subject matter of these laws?

Especially noteworthy are:

  • EGVG (Introductory Act to the Administrative Procedures Acts):
    The EGVG determines which administrative organs are to apply the administrative procedural laws in which matters. In addition, some terms of administrative procedural law are defined (e.g., authorities, administrative offenses).
  • AVG (General Administrative Procedure Act):
    The AVG regulates general issues (e.g., authority competences, party status, deadlines) and the course of administrative proceedings (e.g., appeals procedure, decision-making procedure).
  • VStG (Administrative Penal Code):
    In addition to some general definitions, the VStG mainly contains the design of the administrative penal procedure and provisions on the enforcement of the penalty.
  • VwGVG (Administrative Court Procedure Act):
    The VwGVG regulates the procedure of the administrative courts with the exception of the Federal Finance Court and is thus the relevant procedural law for the proceedings before the administrative courts.
  • VVG (Administrative Enforcement Act):
    The VVG regulates the enforcement of decisions of administrative authorities and administrative courts as well as the issuance of interim injunctions. Here, too, the Federal Finance Court constitutes an exception.

In addition to these five administrative procedural laws, there are also some ancillary laws, with particular mention to the Service Act and the E-Government Act. The former regulates the service of documents, while the latter establishes the conditions under which electronic communication can take place.
