FAQ

Can the principle of marital property division be deviated from?

Since the division of marital property should be as amicable as possible, it is possible to conclude a division agreement. In the event of a divorce, the court is bound by this agreement and can only deviate from it if one party would be unfairly disadvantaged and compliance with the agreement would therefore be unreasonable. More and more frequently, future spouses decide to conclude a prenuptial agreement.
