I, Michael Ibesich, attorney-at-law, Josefstädter Straße 11, 1080 Vienna (hereafter referred to as "I"), respect your privacy and take the protection of your personal data seriously. I treat your personal data confidentially and I therefore comply with the applicable statutory data protection regulations, in particular the Austrian Data Protection Act (DPA), the EU General Data Protection Regulation (GDPR) and the Austrian Telecommunications Act (TCA) as well as this data protection declaration.
What is personal data?
Personal data is information about data subjects (natural persons) whose identity is or can be identified. Examples of such data are name, date of birth, address, e-mail address, telephone number, gender, social security number, but also photos, video recordings and biometric data such as fingerprints. Sensitive data such as health data or data relating to criminal proceedings may also be included.
Processing and use of personal data
I collect, process and use your personal data only if there is a legal basis in accordance with the GDPR or only with your consent or assignment for the purposes agreed with you. I will only process data that is necessary for the execution and handling of my legal services or that you have voluntarily provided me with.
If you contact me via the contact form on my website, by telephone, e-mail or fax, I will process the personal data you provide (title, name, e-mail address, telephone number, fax number as well as any other data disclosed and any documents and certificates transmitted) for the purpose of processing your inquiry. I will process these data for the purpose of fulfilling (pre-)contractual obligations or on the basis of legitimate interests.
I would like to point out that data transmission over the Internet (e.g. communication by e-mail) may have security gaps. A complete protection of data against access by third parties is not possible.
Transfer of personal data
In order to fulfill your request, it may also be necessary to forward your data to third parties (e.g. opposing party, substitutes, insurance companies, service providers I use and to whom I make data available, etc.) or to courts or authorities. Your data will be forwarded exclusively on the basis of the GDPR, in particular to fulfill your order or on the basis of your prior consent.
Within the scope of my legal representation, it is also regularly necessary to obtain factual and case-related information from third parties. All this is done in accordance with the relevant data protection regulations.
Web analysis services (tracking)
I use on my website fonts ("Fonts") of the provider Adobe (Adobe Systems Incorporated, 345 Park Avenue, San Jose, CA 95110-2704, USA). For this purpose, it may be necessary for Adobe to become aware that my website has been accessed from your IP address. The use of Adobe fonts is in the interest of an appealing presentation of my online offer and represents a legitimate interest within the meaning of Article 6 para 1 (f) GDPR.

I integrate maps ("Google Maps") of the provider Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. To use the functions of Google Maps, it may be necessary to store your IP address. A transmission and storage of this information usually takes place on a server of Google in the USA. I have no influence on this data transmission. The use of Google Maps is in the interest of an attractive presentation of my online offers and an easy location of the places indicated by me on the website and represents a legitimate interest within the meaning of Article 6 para 1 (f) GDPR.
Server log files
For reasons of operational security, the hosting provider collects data about access to the site and stores it as server log files. These log files are stored for four weeks and then deleted. The statistical evaluation of the accesses provided by the provider does not contain any IP address.
Duration of storage of personal data
I only store your data for as long as I need it to fulfill the purposes already described and to fulfill my contractual or legal obligations. If your personal data is no longer required, it will be deleted or made anonymous so that you can no longer be identified. I will not keep data longer than necessary to fulfill my contractual or legal obligations and to defend myself against possible liability claims.
The protection of your personal data is ensured by appropriate technical and organizational security measures. Despite all efforts, it cannot be ruled out that information I receive from you via the internet may be viewed by third parties. Therefore, I cannot assume any liability whatsoever for the disclosure of information due to errors in data transmission not caused by me and/or unauthorized access by third parties (e.g. hacking of e-mail accounts).
Information, change of data and deletion
As a data subject, you have the right to be informed at any time about the personal data I have stored.
You also have the right to correct incorrect data and, under certain circumstances, to have your data deleted. If the processing of personal data is based on your consent, you can revoke your consent to the processing of personal data with effect for the future. You may have the right to have the personal data you have provided me with released in a structured, common and machine-readable format. You have the possibility to contact a data protection supervisory authority (in Austria: Austrian Data Protection Authority) with your possible complaint.
If there are any changes to your personal data, please inform me accordingly.
I endeavor to ensure that data breaches are detected at an early stage and, if necessary, immediately reported to you or the relevant regulatory authority, including the respective data categories that are affected.
